Jersey College Waiver and Release Agreement

Authorization, Waiver, and Release of Testimonial Information

For good and valuable consideration, the receipt and sufficiency of which are acknowledged, I hereby voluntarily, knowingly, and without coercion irrevocably consent to and authorize Jersey College and its successors and assignees (the “College”) the worldwide and perpetual right and permission to:

• Take, record, publish, or obtain any and all current and future testimonies, reviews, feedback, statements, letters, e-mails, or other statements made or provided by me for or in relation to Jersey College, including the testimonial statement above (“Statements”), along with any images or videos I provide (the "Testimonial Content");
•  use, copy, modify, adapt, distribute, publish, display, or exhibit in any media, including but not limited to, the Internet, social media platforms, types of advertising and promotion by any means, methods, and technologies now known or hereafter to become known, either in whole or in part, the Testimonial Content for commercial and business purposes, including, without limitation advertising, marketing, and promotional materials; and
• use my first name, last initial, enrollment, graduation information (including, but not limited to, campus, program of study, graduation date), and relationship with the College, along with my Testimonial Content. I further agree that the College will have the right to attribute the Testimonial Content to me, as an expression of my personal experience and beliefs.

Further, I agree that the above consents and authorizations are perpetual, worldwide, non-revocable, royalty-free, pledgeable, and sublicensable. I agree that the use of the Testimonial Content and/or the above-mentioned attributions, in each case whether in whole or in part, will be at the sole discretion of the College. I agree that the College may edit, modify, and reformat the Testimonial Content and publish edited, modified, or reformatted versions (including, but not limited to partial versions) of the Testimonial Content; provided, however, the College may not edit the Testimonial Content in such a way as to create a misleading impression of my views.

I agree that my Statements are a bona fide expression of my opinions, strictly factual, and a portrayal of currently correct conditions or facts.

I hereby waive any and all rights that I may have over the use, distribution, transfer, or display of the Testimonial Content, including, without limitation, any right to inspect and/or approve such use, distribution, transfer, or display. To the extent that I have any moral rights in the Testimonial Content, I waive all such moral rights in favor of the College and anyone authorized by the College to use the materials.

I confirm that I have all necessary rights or permissions to the Testimonial Content, including any uploaded images provided as part of my Testimonial Content. Further, I hereby release and discharge, and agree to release and discharge, the College from any and all claims arising from or related to the use of the Testimonial Content, including but not limited to claims for violation of copyright, invasion of privacy, right of publicity, and/or defamation. I irrevocably waive to the fullest extent possible any personality rights, publicity rights, privacy rights, and any similar or related rights I may have under the law in any jurisdiction.

I understand and acknowledge that I will not receive any compensation (monetary or non-monetary) from the College, other than the goodwill or publicity (such items being consideration for this Testimonial Waiver and Release) that I may receive relating to the College’s publication, distribution, or other use of the Testimonial Content as set forth in this Testimonial Waiver and Release. I agree not to make any monetary or other claim against the College for the use of the Testimonial Content. This Testimonial Waiver and Release is being made and entered into under the laws of the State of New Jersey and shall be governed and interpreted in accordance with the laws of said state. I represent and warrant that I am over the age of eighteen (18) years. I accept and understand that this Testimonial Waiver and Release is binding on me, my heirs, legal representatives, and assigns. I have read this Testimonial Waiver and Release carefully before signing, and I acknowledge that I entered into this Testimonial Waiver and Release at my own initiative and fully understand the contents thereof.

I have read the authorization, waiver, and release information and give my consent to use the Testimonial Content as indicated above.
